1. Agreement to Terms
Welcome to WildPath Treks. By accessing our website and booking our adventure tours, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services. These terms apply to all visitors, users, and others who access or use our services.
WildPath Treks reserves the right to update, change, or replace any part of these Terms of Service by posting updates on our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
2. Booking and Reservations
2.1 Booking Process
All bookings must be made through our official website, email, or phone contact. A booking becomes confirmed only upon receipt of the required deposit and written confirmation from WildPath Treks. We recommend booking well in advance, especially for peak season expeditions, as spaces are limited to ensure quality experiences.
2.2 Payment Terms
A non-refundable deposit of 30% is required at the time of booking. The remaining balance must be paid no later than 60 days before the expedition start date. Full payment is required for bookings made within 60 days of departure. We accept payment via bank transfer, credit card, and approved payment platforms.
Important: Failure to pay the balance by the due date may result in automatic cancellation of your booking and forfeiture of your deposit.
3. Cancellation and Refund Policy
3.1 Cancellation by Participants
- More than 90 days before departure: Full refund minus deposit (30%)
- 60-90 days before departure: 50% refund of total booking amount
- 30-59 days before departure: 25% refund of total booking amount
- Less than 30 days before departure: No refund
3.2 Cancellation by WildPath Treks
We reserve the right to cancel any expedition due to insufficient bookings, adverse weather conditions, safety concerns, or circumstances beyond our control. In such cases, participants will receive a full refund or the option to transfer to an alternative expedition. WildPath Treks is not liable for any additional expenses incurred by participants including travel arrangements, accommodation, or time off work.
4. Participant Responsibilities
4.1 Health and Fitness Requirements
Participants must honestly assess their physical fitness and health condition before booking. All expeditions require a reasonable level of fitness appropriate to the difficulty rating. Participants must disclose any medical conditions, allergies, dietary requirements, or physical limitations that may affect their ability to complete the expedition safely.
4.2 Equipment and Preparation
Participants are responsible for bringing appropriate personal clothing and equipment as specified in the pre-expedition information pack. WildPath Treks provides group equipment including tents, cooking gear, and safety equipment. Participants must attend any mandatory pre-expedition briefings and follow all instructions provided by guides.
4.3 Behavior and Conduct
All participants must conduct themselves in a respectful manner toward guides, other participants, local communities, and the environment. WildPath Treks reserves the right to remove any participant whose behavior is deemed dangerous, disruptive, or disrespectful. No refund will be provided in such circumstances, and the participant will be responsible for all costs associated with their early departure.
5. Liability and Insurance
5.1 Limitation of Liability
Outdoor adventure activities carry inherent risks. While WildPath Treks takes all reasonable precautions to ensure participant safety, we cannot be held liable for accidents, injuries, illness, loss of property, or death occurring during expeditions. Participants engage in activities at their own risk and are responsible for their own safety and wellbeing.
5.2 Insurance Requirements
All participants must have comprehensive travel insurance covering medical expenses, emergency evacuation, trip cancellation, and personal liability. Proof of insurance must be provided before expedition departure. WildPath Treks strongly recommends purchasing insurance that specifically covers adventure and trekking activities.
Mandatory Requirement: Travel insurance with adventure activity coverage is compulsory for all WildPath Treks expeditions.
6. Changes to Itinerary
Published itineraries are subject to change due to weather conditions, trail closures, safety considerations, or other circumstances beyond our control. WildPath Treks reserves the right to modify routes, accommodation, activities, or duration of expeditions when necessary. We will make every effort to provide comparable alternatives, but no compensation will be provided for such changes.
Guides have absolute authority to make decisions regarding route changes, rest days, or early termination of expeditions when participant safety is at risk. All such decisions are final and made in the best interest of the entire group.
7. Photography and Media
WildPath Treks may take photographs and videos during expeditions for promotional purposes including website, social media, and marketing materials. By participating in our tours, you consent to being photographed and grant WildPath Treks permission to use these images without compensation. If you prefer not to be photographed, please inform your guide at the beginning of the expedition.
8. Environmental Responsibility
All participants must adhere to Leave No Trace principles and follow environmental guidelines provided by guides. This includes proper waste disposal, respecting wildlife, staying on designated trails, and minimizing environmental impact. Violation of environmental regulations may result in removal from the expedition without refund and potential legal consequences.
9. Complaints and Disputes
Any complaints should be raised immediately with expedition guides to allow for prompt resolution. If issues cannot be resolved on-site, participants should submit written complaints to WildPath Treks within 14 days of expedition completion. We will investigate all complaints thoroughly and respond within 30 days.
These Terms of Service are governed by Australian law. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
10. Intellectual Property
All content on the WildPath Treks website including text, images, logos, route descriptions, and materials is protected by copyright and intellectual property laws. Unauthorized use, reproduction, or distribution of any content is strictly prohibited without express written permission from WildPath Treks.
11. Privacy and Data Protection
WildPath Treks is committed to protecting your personal information. Collection, use, and storage of personal data is governed by our Privacy Policy. By using our services, you consent to data collection and use as described in our Privacy Policy. We implement appropriate security measures to protect your information from unauthorized access or disclosure.
12. Force Majeure
WildPath Treks shall not be liable for any failure to perform obligations under these terms due to circumstances beyond reasonable control including but not limited to natural disasters, extreme weather events, pandemics, government restrictions, civil unrest, or other force majeure events. In such circumstances, we will work with participants to reschedule expeditions or provide credit toward future bookings where possible.
